General Condition of Sale

The products available on the quicklypiercing.com website have been created by MTS Srl – VAT no. 08823160968 – REEA (Economic Register) no. MI-2051199 – with head office in 20133 Milano, Via Garofalo 44.

The offer and sale of the products available on the quicklypiercing.com website are governed by the General Conditions of Sale described below, which are an integral part of the purchase contract of any product.

The applicable General Conditions of Sale shall be deemed expressly accepted by the Customer upon placing the order according to the relative instructions.

MTS Srl reserves the right to amend these General Terms and Conditions of Sale at any time, including in consideration of possible regulatory changes. Such amendments will be effective from the date of publication on quicklypiercing.com and will be applied exclusively in relation to purchase orders paid after the date of the amendment.

Article 1 – Purchase

The essential characteristics of the products are presented on the quicklypiercing.com website inside each product sheet.

Products can be purchased on the quicklypiercing.com website 24 hours a day. Orders received at the weekend will be processed on the following Monday; orders received on a public holiday will be processed on the next working day.

In order to make a purchase on quicklypiercing.com the customer must provide MTS with all the data requested on the order form available on the website. All the sections of the order form sent by the customer must be completed.

Failure to provide or incorrect provision of data will necessarily make it impossible to fulfil the obligations deriving from any executed sales contract.

The entered data are processed by MTS srl in compliance with and in accordance with the provisions on the protection of personal data.

The products in the cart can be viewed, modified in quantity and deleted by the customer until the order is confirmed.

By clicking on the “place order” button, the customer confirms the order to MTS Srl.
The order is to all intents and purposes a contractual proposal by the customer.

The selling party will send the customer an order summary for all purchased products.
The order summary will contain information relating to the purchase: product, unit price and total price including taxes, quantity ordered, shipping costs, payment method, invoicing and delivery address.

Article 2 – Price and payment

The prices shown for each article offered for sale by quicklypiercing.com are expressed in Euros and are intended as retail prices inclusive of packaging and VAT, but not shipping costs and customs duties.

The prices of the products published on quicklypiercing.com do not include taxes, duties and levies
that may be applicable in the country of destination of the products, if other than Italy; any such taxes, duties and levies will be charged to the customer.

MTS srl reserves the right to amend the prices of the products offered and sold on quicklypiercing.com at any time. However, any such amendments shall not be effective for customers who have already paid the order.

MTS srl offers two payment methods: by means of the protected Paypal system and by bank transfer.

The customer is required to indicate the method of payment he or she wishes to use from among those available.

2.1 Payment through Paypal

In the case of payment by Paypal, the customer shall provide the system with the data requested, without specifying their credit card details. Paypal also allows payment by credit card, without the need for a Paypal account.
Financial information (such as credit/debit card number or expiry date) will be forwarded, via encrypted protocol, to circuits that provide the relative remote electronic payment services, without third parties being able to access it in any way.
Moreover, this information will never be known to quicklypiercing.com.

2.2 Payment in advance by bank transfer

If payment is made in advance by bank transfer, the ordered goods will only be dispatched once payment has been credited to MTS Srl.
The reason for the bank transfer must include the order identification (type and order number).

In any case, the order will be prepared and shipped by MTS upon receipt of payment.
Delivery times are calculated from the date the order is dispatched.

Article 3 – Shipping

Shipping costs will be charged to the buyer and their cost will be added to the cost of the product.

Shipping costs will be calculated at the time of the order and before payment according to destination and weight/volume of the package.

MTS undertakes to deliver the products to the courier within 2 – 5 working days from receipt of payment.

MTS ships goods worldwide. Goods will arrive directly at the delivery location indicated by the customer. Delivery times vary depending on destination.

MTS disclaims any liability for non-delivery or delayed delivery of ordered products due to force majeure causes (strikes, public authority measures, fires, floods, etc.).

Upon receipt of the products, the customer must check that the package is perfectly closed and intact. If the package is damaged, the customer must report the situation to the courier and promptly notify MTS by email. Otherwise, the products will be considered regularly delivered.

Article 4 – Complaints, returns and refunds

Complaints of any kind must be notified in writing by email within 8 (eight) days of receipt of the goods and must clearly state the necessary references (product name, date and order reference number indicated in the order details, number and date of payment).

With the exception of whatever has been agreed in the Right of Withdrawal clause below, returns must be authorised in advance in writing by MTS by email, under the conditions to be established from time to time.

The customer shall return the product to MTS at the address provided by email and shall deliver the goods to the courier – of the customer’s choice – within 5 days from receipt of the email from MTS.

Shipment must be traceable. The customer will only be charged the cost of returning the product.

The products must be returned intact, correctly packaged in their original packaging, in perfect condition for resale, with the transport document present in the original packaging, with no obvious signs of use.

In the event that reimbursement operations are necessary due to the return of products following the exercising of the right of withdrawal or returned as a result of a complaint, MTS will implement, through participating banking circuits, the procedures necessary to ensure successful refund.

Refunds will be made using the same method of payment used by the customer, unless the customer has expressly requested a different method (e.g. a voucher for a subsequent purchase).

MTS nevertheless reserves the right to suspend payment of the refund until actual receipt of the goods.

The same indications apply to customers making purchases outside Italy.

Article 6 – Right of Withdrawal

Every customer may exercise his or her right of withdrawal from the contract concluded with MTS within 14 (fourteen) days, starting from the day of receipt of the products purchased from the shop, without any penalty and without having to provide any justification.

The customer will only be charged the costs of returning the product.

Article 7 – Privacy

Personal data are collected and processed by MTS as Data Controller, in relation to the contract to which the data subject is a party, for purchase-related purposes such as accounting and shipping of goods.

Further processing may be carried out by MTS on the basis of legitimate interest to pursue legitimate purposes such as, for example, answering customer requests, meeting special needs, defending a right in court.
The data of the data subjects may be processed by Managers and Authorised Persons in compliance with the provisions of the law on the protection of personal data.

The transfer of data to non-EU countries (e.g. USA), also in connection with the IT tools used by the Data Controller, shall take place in compliance with and in the cases provided for by the law on personal data protection.

MTS processes personal data in compliance with European and Italian privacy regulations and the data subjects may exercise their rights (access, rectification, erasure, restriction and portability), where possible by writing to the Data Controller. They also have the right to lodge a complaint with the Supervisory Authority if the requirements are met.

Article 8 – Conclusion of the contract

The online sales contract governed by these General Terms and Conditions of Sale is concluded when the consumer/buyer/professional receives a payment confirmation/order summary from the seller.

The purchase contract is concluded by means of an irrevocable order from the buyer, by completing and sending the online order form, which will be displayed on the order summary web page, is printable and which shows the details of the customer and the order, the price of the goods and the shipping costs, the payment methods and terms, and the address to which the goods are to be delivered.

Article 9 – Applicable Law

The sales contract between MTS and the Buyer is concluded in Italy and governed by Italian law.
Any unresolved disputes shall fall under the jurisdiction of the Court of Milan.
